Meeting Minutes

August 18, 2000 at approximately 12:30 p.m. on Friday, August 19, 2000, at the offices of Honigman Miller Schwartz & Cohn in Lansing, Michigan

In attendance were: H. Iwrey, D. Chardavoyne, D. Gravelyn, G. Wittrock, and J. Deline, (by telephone).

Approval of Minutes
    The minutes for the meeting of the Executive Council of June 23, 2000 were allegedly taken by E.Basten, who was not in attendance at this meeting. Approval of the minutes was therefore tabled until the next meeting.
Treasurer’s Report
    The Treasurer, Mr. Deline, provided the Treasurer’s report. He stated that the Section had income of $20 for the last reporting period and a balance of $17,396.89 as of June 30, 2000.
Committee Reports
  • Franchise Committee
    There was no Franchise Committee report.
  • Newsletter Committee
    The Council discussed a number of ideas for newsletter articles, including an article about the FTC franchise rules, amendments to the Hart-Scott-Rodino Act, and an update on the recently completed Gambro litigation. The Council also discussed new antitrust filings. It was noted that an action was filed against Northwest Airlines for monopolization in the Eastern District. In addition, the Attorney General joined twenty other states in filing a MAP case against record distributors.
  • Legislative Committee
    The Council discussed the pending legislation to amend the Hart-Scott-Rodino Act. The bill has been reported out of the House Judiciary Committee and establishes new benchmarks and new fees for filing. We will continue to monitor this legislation. It was noted that the Section might have a new opportunity to have an antitrust or trade suffix for tracking circuit court filings since control over the suffixes has been transferred to a court administrative committee.
  • Education Committee
    The Council discussed the possibility of a seminar on the franchise rules when the FTC issues them. Two other issues identified as possible seminar subjects were digital discovery and e-commerce (privacy, B2B, pricing).
  • Website Committee
    There was no report.
  • Nominations
    The Council appointed Mr. Wittrock, Mr. Deline, and Mr. Gravelyn as a subcommittee for nominations. There appear to be four vacancies for the Council this year. Mr. Chardavoyne expressed his interest in being reappointed to the Council.

    There was no old business
New Business
    There was no new business.
State Bar Communications
    There were no new State Bar communications. The Council noted that the State Bar meeting was scheduled to begin on Wednesday, September 20, 2000, and that there would be an Executive Council breakfast and regular meeting on the first day of the State Bar Convention.
Next Meeting and Meeting Location
    The Council agreed to meet next at the State Bar Convention, on September 20, 2000.
