Meeting Minutes

October 5, 1998 at 4:20 p.m. at the offices of May, Simpson & Strote in Bloomfield Hills, Michigan

In attendance were: J. Forrest, H. Iwrey, M. Boonstra, D. Gravelyn (by telephone), S. Raymond, and R. Kalisher.

Approval of Minutes
    The Minutes for the September 16, 1998 Council Meeting were approved without amendment.
Treasurer’s Report
    J. Forrest reported that he has been unable to speak further with Sally Foley regarding the seminar planned for January/February 1999, but that Paul Novak of the Michigan Attorney General’s office had agreed to speak on franchising.

    A discussion ensued concerning possible topics for the seminar, including a general update on current trends in franchise law and on such recent cases as Kodak and Meineke.
Committee Reports
  • Franchise Committee
    Mr. Forrest indicated that he would speak with J. Swanson regarding the planned November/December 1998 edition of the section newsletter, and welcomed any contributing articles.
  • Newsletter Committee
    Mr. Forrest indicated that he would speak with J. Swanson regarding the planned November/December 1998 edition of the section newsletter, and welcomed any contributing articles.
  • Legislative Committee
    No report. Mr. Iwrey noted, however, that the uniform trade secret bill had passed, and probably would be signed after the November election.
  • Education and Seminars Committee
    Mr. Forrest suggested, in light of the success of the September joint seminar with the Business Law Section, that the section conduct a similar joint seminar in the future. Mr. Iwrey suggested the holding of one or two late afternoon mini-seminars. Council members agreed to consider possible topics for such mini-seminars.
Old Business
    Mr. Forrest reported that, at ICLE’s request, he had prepared a cover letter for the new Antitrust Digest, and that he understood the Judges’ copies to have been distributed. Section members’ copies should be distributed very shortly. Mr. Forrest also discussed the State Bar’s Access to Justice program, to which the section previously had agreed to make a contribution.
New Business
    There was no other new business.
State Bar Communications
    Mr. Forrest reported that he had received a communication enclosing a list of council positions. He also had received a communication concerning the Justice for All program and a report on 1997 grants. Copies are available for interested persons. Another State Bar communication described the procedures for State Bar sections and committees to submit proposals to the State Bar Representative Assembly, which has scheduled three meetings for the coming year. Mr. Forrest invited any ideas for submission to the Representative Assembly. Mr. Forrest also indicated that he had received a communication concerning his automatic appointment to the State Bar Committee on Annual Meeting Coordinating, and he invited any ideas concerning the coordination of the next Annual Meeting.
Next Meeting
    The next meeting of the council is scheduled for Tuesday, November 3, 1998 at 12:00 noon at the Detroit office of Honigman, Miller, Schwarz and Cohn.
Adjournment
    The meeting was adjourned at 5:00 p.m.
