Meeting Minutes

September 16, 1998 at 9:15 a.m. at the Lansing Center in Lansing, Michigan, immediately following the Annual Meeting of the Section

In attendance were: J. Forrest, J. Swanson, H. Iwrey, M. Boonstra, D. Gravelyn, J. DeLine, E. Bladen, D. Miela, and R. Kalisher.

Thank You's
    Incoming Chairperson John Forrest expressed his appreciation and that of the Council to outgoing chairperson Joanne Swanson for her excellent service over the past year. He indicated that Ms. Swanson has agreed to continue to lend her services in connection with the Section newsletter. Mr. Forrest also welcomed incoming councilmember Rick Kalisher to the Council.
Approval of Minutes
    The Minutes for the August 4, 1998 Council Meeting were approved without amendment.
Election of Officers
    It was moved and seconded that the following slate of officers be elected to serve in the coming year:

    Secretary

    Treasurer
    Daniel R. Gravelyn

    The motion carried.

Committee Reports
  • Franchise Committee
    Mr. Forrest reported that he is working with Sally Foley on a seminar planned for January 1999. Possible topics include a change in Illinois law to ease registration renewal, and a movement in Ontario toward a disclosure law.
  • Newsletter Committee
    Ms. Swanson reported that the August 1998 edition of the newsletter has been distributed. She indicated that the next edition of the newsletter is planned for November or December 1998, and requested that anyone with ideas for the newsletter contact her or John Forrest.
  • Legislative Committee
    Mr. Bladen reported that there are some bills pending in the Michigan legislature that would amend the Michigan Consumer Protection Act. Mr. Bladen raised the issue of the Section’s continuing jurisdiction over consumer law issues, given the State Bar’s formation of a Consumer Law Section. Mr. Forrest expressed the view that the jurisdiction of the sections is overlapping, and that the Antitrust, Franchising and Trade Regulation Section continues to have jurisdiction over consumer protection issues.

    Mr. Bladen also reported that the Michigan RICO law has passed, and that it includes as a predicate act a violation of the antitrust laws.
  • Education and Seminars Committee
    Mr. Forrest stated that immediately following the Council Meeting the Section would hold a joint seminar with the Business Law Section, and that, if it is successful, he would recommend doing so again in the future.
Old Business
    Ms. Swanson reported that the new Antitrust Digest would be distributed shortly, and was on display at the Annual Meeting of the State Bar.

Next Meeting
    The next meeting of the council is scheduled for Monday, October 5, 1998 at 4:00 p.m. at May, Simpson & Strote, 100 W. Long Lake Road, Suite 200 (just West of Woodward), Bloomfield Hills, MI.
Adjournment
    The meeting was adjourned at 9:35 a.m. in favor of the joint seminar with the Business Law Section.
