FOCUS: HB 5307 (Van Regenmorter) Uniform Principal and Income Act – PA 159 of 2004
Effective 9/1/04
Probate; trusts; new uniform principal and income act; enact. Creates new act.
The legislation was drafted by the Probate and Estate Planning Section of the State Bar in cooperation with the Michigan Banker’s Association. The legislation deals with the determination of income and principal for estate and trust accounting purposes and brings Michigan legislation in conformity with the prudent investor rule adopted as part of the Estates and Protected Individuals Code effective April 2000.

Probate; wills and estates; general amendments to the estates and protected individuals code; provide for. Amends secs. 1105, 2114, 2301, 2714, 2902, 2910, 3715, 3803, 3917, 3920, 3923, 7303, 7307, 7406 & 7408 of 1998 PA 386 (MCL 700.1105 et seq.) & adds sec. 7410.
The legislation includes technical amendments to the Estates and Protected Individuals Code drafted by the Probate and Estate Planning Section in cooperation with the Michigan Banker’s Association.
