This presentation will assist health care employers in understanding: the proper utilization of social networking sites for applicant screening; the effective management of social media in the workplace; and the limitations on dealing with employees who misuse electronic communications. There will be a special emphasis placed on National Labor Relations Board decisions that apply to virtually all private-sector employers. The presentation will also briefly describe other recent NLRB decisions governing the wearing of badges and insignia in patient treatment areas—new restrictions on the utilization of old world media.

Speakers

    Tom Barlow is a partner in the Detroit office of Jackson Lewis LLP. With more than 36 years of experience representing management in virtually all aspects of employment and labor law, Mr. Barlow applies a diverse background when he assists employers in confronting the complexities of contemporary human resources management. His extensive experience in traditional labor law includes negotiation and administration of collective bargaining agreements as well as assisting in the maintenance of a union free work place. He defends allegations of discrimination and harassment, wrongful dismissal, Sarbanes-Oxley whistle blowing, and retaliation. He has served as outside EEO counsel for a national nonprofit organization, where he coordinated the defense of politically sensitive litigation across the United States. Mr. Barlow has particular experience in health care, having worked with numerous acute care hospitals and assisted living facilities.

    Rod Gillum is also a partner in the Detroit office of Jackson Lewis LLP and a member of the firm's corporate compliance/governance practice group as well as the corporate diversity counseling group. Mr. Gillum's practice concentrates on corporate strategies related to diversity planning, labor relations, crisis management, and legal risk avoidance, including managing strategic labor and personnel planning in the context of workforce restructurings, class actions, and corporate reorganizations. He has earned a national reputation for corporate diversity and public-interest initiatives. His unique array of legal, crisis management, and corporate governance experiences has engendered the trust of company leaders, judges, politicians, and attorneys as an effective, thoughtful, and creative problem solver.
