Michigan Supreme Court Notice of Public Administrative Hearing

Pursuant to Administrative Order No. 1997-11, the Michigan Supreme Court will hold a public administrative hearing on Thursday, September 25, 2003, in the Supreme Court courtroom located on the sixth floor of the Michigan Hall of Justice, 925 W. Ottawa Street, Lansing, Michigan 48915. The hearing will begin at 9:30 a.m. and adjourn no later than 11:30 a.m. Persons who wish to address the Court regarding matters on the agenda will be allotted three minutes each to present their views. Any questioning of the speakers by the Justices will take place after that time. To secure a place on the agenda, please notify the Office of the Clerk of the Court at P.O. Box 30052, Lansing, Michigan 48909, or MSC_clerk@courts.mi.gov, no later than Tuesday, September 23, 2003. Administrative matters on the agenda for this hearing are:

1. 2002-34 Proposed Amendments of Rules 7.204, 7.210, and 7.212 of the Michigan Court Rules.

Issue: Whether to amend these rules to aid the effort of the Court of Appeals to reduce delays in evaluating, processing, and deciding cases on appeal.

2. 2002-49 Proposed Amendment of Canon 7 of the Michigan Code of Judicial Conduct.
Published at 468 Mich 1205-1207 (Part 1, 2003).
Issue: Should Canon 7B(1)(d) be amended to require that the first name of a judicial candidate be included in all forms of communication promoting election?

3. 2002-50 Proposed Amendment of Canon 7 of the Michigan Code of Judicial Conduct.
Published at 468 Mich 1205-1207 (Part 1, 2003).
Issue: Should Canon 7B(2)(d) be amended to correct for "unfairness" in solicitation of funds for candidates seeking judicial office?

4. 2003-09 Proposed Amendment of Canon 7 of the Michigan Code of Judicial Conduct.

Issue: Should Canon 7B(2)(a) and (b) be amended to clarify that Canon 7B applies to all candidates for judicial office, not just incumbent judges?

5. 2002-52 Proposed Amendment of Rule 15 of the Rules Concerning the State Bar of Michigan.

Issue: Should this rule be amended to make uniform the length of time that an unsuccessful bar candidate must wait before reapplying for admission?

6. 2002-53 Proposed Amendment of Rules 1.109 and 2.113 of the Michigan Court Rules.
Published at 468 Mich 1201-1202 (Part 1, 2003). Issue: Should there be a standardized type size for all pleadings, motions, affidavits, and other papers?

7. 2002-54 Proposed Adoption of New Rule 2.406 of the Michigan Court Rules.
Published at 468 Mich 1209-1210 (Part 1, 2003). Issue: Should the Court adopt a statewide fax-filing rule?

8. 2003-13 Proposed amendment of Rule 5.408 of the Michigan Court Rules. Published at 468 Mich 1221-1222 (Part 1, 2003).
Issue: Should the court rule be amended to allow probate courts to take local circumstances into account in designing more effective ways to protect legally incapacitated persons, while lowering the costs currently charged to estates?

9. 2003-23 Caseflow Management Standards.

Issue: Should the Court adopt a new administrative order to govern the management of cases, including time guidelines for monitoring case processing?

10. 2003-39 Amendment of Rule 3.955 of the Michigan Court Rules.
Published at 469 Mich (Part 1, 2003).
Issue: Should the Court retain this amendment, which, in conformity with People v Petty, 469 Mich ___ (2003), gives a juvenile defendant, the juvenileƕs counsel, the prosecutor, and the victim an opportunity to address whether the court should enter an order of disposition or impose or delay imposition of sentence?
