Michigan Supreme Court Second Revised Notice of Public Administrative Hearing

Pursuant to Administrative Order No. 1997-11, the Michigan Supreme Court will hold a public administrative hearing on Thursday, June 19, 2003, in the Supreme Court courtroom located on the sixth floor of the Michigan Hall of Justice, 925 W. Ottawa Street, Lansing, Michigan 48915. The hearing will begin at 9:30 a.m. and adjourn no later than 11:30 a.m. Persons who wish to address the Court regarding matters on the agenda are advised that they will be allotted three minutes each to present their views. Any questioning of the speakers by the Justices will take place after that time. To secure a place on the agenda, please notify the Office of the Clerk of the Court at P.O. Box 30052, Lansing, Michigan 48909, or MSC_clerk@courts.mi.gov, no later than Tuesday, June 17, 2003.

1. 2001-29 Proposed amendment of Rule 702 of the Michigan Rules of Evidence.

Issue: Whether to amend this rule to add a provision codifying the trial judge's role as "gatekeeper" for novel expert testimony.
  
2. 2002-46 Proposed amendment of Rules 7.304, 9.114, and 9.122 of the Michigan Court Rules.
Published at 467 Mich 1226-1227 (Part 4, 2002).
Issue: Whether to clarify those instances in which a complaint for mandamus is appropriate.
  
3. 2002-34 Proposed amendment of Rules 7.211 and 7.216 of the Michigan Court Rules.

Issue: Whether to adopt amendments regarding vexatious proceedings.
Note: The public hearing has been postponed regarding the amendments of MCR 7.204, 7.210, and 7.212 that were proposed by the Court of Appeals to aid its delay-reduction effort. The comment period for those items has been extended to September 1, 2003.
  
4. 2002-44 Administrative Order No. 2002-5 authorizing differentiated case scheduling at the Court of Appeals.

Issue: Whether to retain this administrative order, which authorizes differentiated case management in the Court of Appeals on a temporary basis.
  
5. 2002-38 Proposed amendment of Rule 4 of the Rules Concerning the State Bar of Michigan.

Issue: Whether to impose a $15 annual assessment for the Client Protection Fund and to gradually increase to $140 the amount designated for the attorney-discipline agencies. (See also Item 6, below.)
  
6. 2003-14 Proposed amendment of Rules 3 and 4 of the Rules Concerning the State Bar of Michigan.

Issue: Whether to increase the amount of general dues by $40, to institute certain fees, and to make other changes in related provisions. (See also Item 5, above.)
  
7. 2002-13 Proposed amendment of Rule 3.210 of the Michigan Court Rules.

Issue: Whether to modify the procedures by which, and the extent to which, in camera testimony may be taken in custody cases?
  
8. 2003-07 Proposed amendment of MCR 3.973, 3.974, 3.975, and 3.977.

Issue: Whether to amend the rules concerning the availability of jury trials on supplemental petitions in child-protective proceedings.
  
9. 2002-47 Proposed amendment of Rule 3.203 of the Michigan Court Rules.

Issue: Whether to amend the domestic relations court rules to clarify requirements regarding service of pleadings and notices.
  
10. 2003-12 Proposed new Rule 3.221 of the Michigan Court Rules.

Issue: Whether to adopt this new rule to implement 2002 PA 567, which amends MCL 552.602, 552.631, and 552.632, to require bench warrants issued in cases involving the failure to pay child support to be processed pursuant to rules established by the Supreme Court.
  
11. 2003-22 Proposed changes in the Child Support Formula Manual.

12. 2002-40 Proposed amendment of Rules 7.302, 7.304, 7.315 of the Michigan Court Rules.

Issue: Whether to provide for oral argument at the application stage, at the discretion of the Supreme Court, and to give the Supreme Court discretion with regard to the time for oral argument in calendar cases.
