The Public Policy Update will not be published on December 24 and December 31. The Update will resume on January 7. The State Bar of Michigan offices will be closed December 24, 2012–January 1, 2013.

In the Capitol
Last week the legislature concluded their work for the 2011-2012 legislative session. The 97th legislative session begins on January 9, 2013. During the lame duck session, the legislature approved and sent 282 bills to Governor Snyder for his approval. Below is a list of the bills with positions by the State Bar of Michigan that were sent to the governor during the last week of session.

The Family Law Section submitted Public Policy position reports on the following items:
Oppose and Amend: HB 5986 Children; parental rights; immediate termination of parental rights and visitation rights for parent or legal guardian upon sentencing for criminal sexual conduct or other sex crimes; require. Amends sec. 19b, ch. XIIA of 1939 PA 288 (MCL 712A.19b).

Oppose and Amend: HB 5987 Family law; parenting time; immediate termination of a grandparenting time order upon sentencing for certain criminal sexual conduct; require. Amends sec. 7b of 1970 PA 91 (MCL 722.27b).

Oppose and Amend: SB 0694 Children; parental rights; probate court jurisdiction to terminate parental rights of a parent who commits a criminal offense against a child; provide for. Amends sec. 2, ch. XIIA of 1939 PA 288 (MCL 712A.2).

Support and Amend: SB 1296 Civil procedure; statute of limitations; statute of repose for actions against an attorney-at-law or a law firm; enact. Amends sec. 5838 of 1961 PA 236 (MCL 600.5838) & adds sec. 5838b.

Oppose: SB 1312 Children; protection; best interest of the child determination relating to child abuse and neglect; modify. Amends secs. 2, 3, 4, 5, 6a, 7, 7a & 7b of 1970 PA 91 (MCL 722.22 et seq.) & adds secs. 3a & 6f.
